The terms on which Malayit provides its services. Last updated 30 September 2026.
01What Malayit is
Malayit provides accountability infrastructure for journeys: intake, route planning, named relay coordination, timed check-ins, an evidence bundle, and arrival confirmation. Malayit is not a transport carrier, a travel agency, a migration adviser, or a legal representative.
02What we promise
We promise to operate the duty stack described on this site: named accountability at each stage, timed check-ins as scheduled, escalation when a window is missed, and an evidence bundle maintained as the journey happens. We do not promise a particular journey outcome, and we cannot guarantee a result that depends on third parties, border authorities or circumstances outside our control.
03What we ask of you
Accurate information at intake, including identity, route intent and a reachable next of kin. Honest updates during the journey. Consent to the processing described in our privacy notice. Compliance with the law in every jurisdiction you travel through. We may decline or end a service where information provided to us is materially false or where continuing would put a person at risk.
04Relay operators
Relay operators are independent, verified in person, and bound by a signed duty stack. They are not employees of Malayit. Where an operator breaches their obligations, we will record the breach, revoke their verification, and disclose the fact to affected subjects and partners.
05Risk and responsibility
Journeys across borders carry inherent risk, including risk arising from authorities, third parties and conditions we do not control. By engaging our services you acknowledge this. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for gross negligence or wilful misconduct.
06The evidence bundle
The evidence bundle belongs to the subject. You may request an export at any time. We do not warrant that a bundle will be accepted by any particular authority or institution, but we do warrant that it is a true record of what was captured and when.
07Fees
Where fees apply, they are agreed in writing before a journey begins. Cost is never a barrier for an individual traveller on a corridor where a partner is covering the cohort. We do not charge contingency fees on outcomes.
08Changes and governing law
We may update these terms and will post the revised date on this page. Continued use after that date constitutes acceptance. These terms are governed by the laws of the Republic of South Africa. Last updated 30 September 2026.
